Prosecutors at the International Criminal Court (ICC) have called on judges to reject Israel’s request to cancel arrest warrants issued for Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant.
In a written submission published Wednesday, prosecutors argued there is “no basis to withdraw or vacate” the warrants, which were issued in November after judges found reason to believe the two officials used starvation as a method of warfare and targeted civilians in Israel’s military campaign in Gaza. Israel has denied the allegations.
The filing, signed on behalf of ICC prosecutor Karim Khan—currently on leave amid a sexual misconduct investigation—stressed the need to continue the case as crimes in Gaza are “ongoing and escalating.”
Israel argues the ICC has no jurisdiction, as it is not a member of the court. However, the ICC recognizes “The State of Palestine” as a member, giving it grounds to investigate alleged crimes in Gaza and the West Bank.
The court also issued a now-withdrawn warrant for Hamas military leader Mohammed Deif, following confirmation of his death in an Israeli airstrike earlier this year.
