Regarding the corruption involvement in awarding the contract to develop Adi Park, the anti-Corruption Commission (ACC) of the Maldives has sent a request to the Prosecutor General (PG) Office to charge against Male’ City Mayor Shifa Mohamed.
As per the ACC’s investigations, the two toilet stalls construction in the contract was granted to AMIN Construction without proper paperwork, and without a transparent and competitive process of bidding.
Furthermore, ACC has found out that she also had requested approval of the quotation of AMIN construction, from the Finance Ministry in accordance with a single source procurement method stated under the Public Finance Regulation. Although the Finance Ministry rejected the request and instructed Male’ City Council to seek approval from its bid committee, the contract was already awarded to AMIN Construction without informing the Bid Committee, or members of the Male’ City Council. For which ACC has said that the construction work could have only been authorised by the head of Male’ City Council, Mayor Shifa, if the Bid Committee has no knowledge of it.
A Sri Lankan company also offered to finance the construction of the two toilet stalls under non-reimbursable financial aid, but Mayor Shifa failed to disclose this information to the Finance Ministry, Male’ City Council members, bid committee members, and Male’ City Council’s Finance section, as required under Public Finance Regulation.
From further investigation ACC also found out that Shifa sent a total of three memos to the Bid Committee requesting the selection of a contractor, one of which was sent on October 21, 2019, after construction work had already begun.
ACC has requested the PG Office for Mayor Shifa to be charged with misuse of official authority as a public official to obtain an undue benefit for one’s own self or for another, under Section 513 (b) of the Penal Code.
