The Democrats President Imthiyaz Fahumy has asserted that only Parliament holds the power to amend the Constitution, as the Supreme Court began hearings on the loss of parliamentary seats for MPs who switch parties.
During today's hearing, the Supreme Court questioned whether Parliament has the authority to amend the Constitution. The court referenced the U.S. Constitution’s 18th Amendment, which prohibited alcohol, and noted that despite public opposition, it remained law until Parliament later repealed it through the 21st Amendment, not through judicial intervention.
A full seven-judge bench is reviewing a petition filed by former Kendhoo MP Ali Hussain, challenging the amendment to Article 73, which mandates that MPs lose their seats if they leave or are expelled from their party.
The next hearing on the case is scheduled for 9 p.m. tonight.
